Australia: 2015 Increases to Pollution Penalties
Commonwealth legislation, which applies to oil spills occurring beyond 3 nautical miles from the Australian coast, has increased the penalty unit applying to fines for Commonwealth maritime offences from A$170 to A$180. The Crimes Legislation Amendment (Serious Drugs, Identity Crime and Other Measures) Act 2012 makes provision for an increase every three years to accommodate changes in the Consumer Price Index. The last increase was in 2012 when the unit was raised from A$110 to A$170. The maximum fine for an Owner or Charterer is now A$18million (A$3.6million for a Master) and will apply to incidents occurring after 1 July 2015.
A majority of Australian State penalties which apply to spills occurring within 3 nautical miles from the coast, also increased on 1 July 2015 in accordance with annual indexation adjustments.
